Auna Select d.o.o. is a villa rental agency, OIB: 16227090223, located in Dubrovnik, Marka Marojice 29.

The user of the website, herein referred to as a customer, declares that he is at least 18 years of age and has the legal capacity to be bound by this agreement and in accordance to the General Terms and Conditions. By using the website, the customer fully accepts all General Terms and Conditions published.

1. DEFINITION

Auna Villas is an independent company who represents various luxury properties in Croatia. The contract entered is between the customer and Auna Select d.o.o. By making a deposit payment, the customer entered the contract and accepted General Terms and Conditions.

You agree to pass on these General Terms and Conditions to all members of your party, as they govern the property rental and everyone in your party. Booking Terms and Conditions are subject to change without notice. The Property Management Company may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.

2. BOOKING

When making a booking, the customer, is required to pay 30% of the rental price. This deposit payment needs to be received within three days of booking to secure the property. All our rates are quoted in Euros.

Once the deposit is received, we will issue a booking confirmation via e-mail. The remaining 70% of the villa rental must be settled 30-45 days prior to arrival, depending on the time of season.

Should you be completing a booking within 4 weeks of your arrival, the full amount of the property cost will be charged.

Additional costs such as gas, electricity, and water are included in the property rental price (excluding rentals lasting two months or longer).

Not included in property rental prices: cost of obtaining passports or visas, transfers, meals and beverages, staff, gratuities for staff, personal expenses such as travel insurance, airfare, airport taxes, shopping services, wellness services. Services booked at the property during your stay will be charged in cash or credit card depending on the service.

3. ARRIVAL AND DEPARTURE

Your property will be ready from 17:00 on the day of your rental start period until 10:00 on the last day of your rental period.

Where possible, we can arrange for your villa to be ready earlier than 5 pm on your day of arrival. It may also be possible to allow you to stay in your villa later than 10 am on your day of departure.

This service is subject to availability and due to the possibility of late bookings on either side of your occupancy, we can normally only confirm an early check-in or late check-out a few days prior to your arrival or departure.

If you know in advance that your flight times are problematic for the check-in or check-out times, and you want to guarantee an early entry or late departure, please consider booking an extra night at the beginning or end of your vacation. Our Team will be happy to advise and talk through your options.

Should you be arriving late at night, there is an administrative cost of 50 EUR for checking in after 21.00.

At the end of your holiday, you are obliged to return us the property keys. Any loss of keys will be charged at 50 E per key. This amount varies in some properties. Should your villa have a remote control for the electric gate, a loss of this remote will cost 100 EUR.

4. REGISTRATION AND NUMBER OF PEOPLE USING ACCOMMODATION

Your property manager will go through the rules and regulations of the property that you are staying in. Upon arrival, all guests must present a valid identification document as we are required by law to register all members of the party with the tourist board.

Unless authorized in writing by Auna Villas, you must not exceed the number of people allowed in the property. In the event that the maximum number is exceeded without prior agreement, the Property Owner reserves the right to refuse or revoke the booking at their sole discretion.

5. SECURITY

Although Croatia is considered to be very safe, we suggest that you use the safe (should your property have one) at all times, keeping your passports and money locked away. When you leave the property, you must lock all windows, doors, and gates securely.

6. LIABILITY

Auna Villas s not responsible for the diminution of enjoyment arising in relation to matters of local engineering, construction works, or weather circumstances.

7. ACCESS

We may need access to the property during your stay for inspection purposes and maintenance required, but we will tell you in advance and keep any disruption to a minimum.

8. PETS

No pets are allowed without our prior written consent. In the event that pets are brought to the villa without prior agreement, the Property Owner reserves the right to refuse or revoke the booking

9. SECURITY DEPOSIT

Security deposit will be collected in cash upon arrival and the amount varies depending on the property. Such an amount will be used to cover any possible damages or loss caused in the property during the rental period.

Once the rental period is over and property manager has checked that the villa remains free of damages or loss caused during the rental period, the deposit will be returned to you.

Should there be any damage to the property we will discuss this together upon check out.

10. CUSTOMER BEHAVIOUR

You must behave considerately towards others. If you cause unreasonable annoyance, noise, damage, crime, or danger, we have the right to evict you. You will be given a verbal warning as a first step. Should the issue continue, you will be issued with a written warning. A third warning will result in eviction from the property. In serious cases, we may evict you without previous warnings.

No parties or functions such as weddings are allowed without our prior written consent of Auna Villas.

Any parties held without previous consent may result in the loss of your security deposit.

Music and any type of noise must be kept to a minimum between the hours of 23:00 – 08:00.

11. CANCELLATIONS OF THE BOOKING BY THE COMPANY

We do not expect to have to make any change to your booking, although we may need to do so in relation to factors beyond our reasonable control. Such factors may include the sale or withdrawal of the property by the owner, or the property otherwise becoming uninhabitable, e.g. due to fire or flood. In such cases, we will advise you of the situation as soon as reasonably possible.

We will always make every effort to find a suitable equivalent alternative. If we are unable to find one for you, or you are unhappy with the alternative offered, we will refund in full all monies paid and shall be under no other liability.

12. CANCELLATIONS OF BOOKING BY THE CUSTOMER

You can cancel a booking at any time. All cancellations must be advised either by email or mail. Our email address is [email protected]

Should your villa booking be affected by Force Majeure you are not entitled to a refund or compensation. Force Majeure means unusual and unforeseeable circumstances beyond the Company’s control, the consequence of which neither the Company could avoid even with all due care, including, but not limited to, war, threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial dispute, unavoidable technical problems with transport, machinery or equipment, power failure, changes imposed by rescheduling or cancellation of flights by an airline, natural or nuclear disaster, fire, flood, drought, adverse weather conditions or epidemics. In order to secure a refund or compensation please contact your Insurance Company in the first instance.

We strongly recommend that you secure adequate travel insurance, which should in most cases, include cover, under certain circumstances, against loss of deposit or cancellation fees, at the time of booking.

13. CONCIERGE SERVICE

We do our best to supply the highest standard for our concierge services. However, as these services are provided by separate companies we are unable to guarantee their performance. Please provide us with as much notice as possible if you require any additional services.

14. CAUTION AND PERSONAL INJURY

We are not responsible for personal injury to you or your party unless we have been negligent. If the negligence is that of the owner, your recourse must be against such a person.

Many of the properties have dangers such as swimming pools, dry stone walls, and unfenced drops. Please take care and caution.

Children must always be supervised, especially around the swimming pool.

We strongly advise customers to purchase their own Travel and Holiday Insurance, which should be valid for the length of your holiday. Neither the property owner nor representative will be held responsible for the loss or damage of personal belongings or personal injury.

It is also worth bearing in mind that holiday properties may not always offer the same standard of comfort and furnishing as your own home. They often reflect local styles, traditions, and owners’ tastes. Comfort levels may be different, for example, kitchens may not include some equipment that is unique to your own kitchen.

15. PERSONAL DATA PROTECTION

Auna Select d.o.o. undertakes to protect the personal data of customers, in such a way that it collects only necessary, basic data about customers/users that are necessary for the fulfillment of our obligations; informs customers about the way the collected data is used, regularly gives customers a choice about the use of their data, including the ability to decide whether or not they want their name removed from lists used for marketing campaigns. All user data is strictly kept and is available only to employees who need this data to perform their work. All employees of Auna Select d.o.o. and business partners are responsible for respecting the principles of privacy protection.

16. PAYMENT

Payment is made via the Monri WSPay payment gateway. Monri WSPay is a secure system for online payments, real-time payments, credit and debit cards and other payment methods. Monri WSPay provides customers and merchants with secure entry and transfer of entered card data, which is confirmed by the PCI DSS certificate that Monri WSPay has. Monri WSPay uses an SSL certificate of 256-bit encryption and TLS 1.2 cryptographic protocol as the highest level of protection during registration and data transfer.
